Being audited by the dept of labor, for 2004-2006, yes, all three years.
Accountant said no big deal, we just need to fill out some paperwork to take care of this- ten min max.
Well, that was then, this is now, call in the day before the audit (the accountants handling it) the accountant says oh, by the way, this isn't what I thought it was, this is very thorough, random, but thorough. They are questioning even the most obvious deductions, tires for through van, hotel stays on training trips etc. etc.
Could this really be that random? God I hope so!
This has been in the works for 2 plus month now! Great timing , HUH?
Why would the dept of labor be doing it, never filed a claim, never had any employees. Yeah, you read it right, no employees, no claims

Any good advice, or hindsight from your experience would be helpful, a hell at this point even words of encouragement would help.

Thanks in advance.

It must be unusual for the department of labor to do an audit. The only time I have heard of one was in conjunction with another taxing body also doing an audit or a simple check of payroll records to see if they matched up with your reports. (Which you would not have if you had no employees.)

I wonder if they suspect you had employees put did not report this. Just trying to think of why they would audit a company with no employees.

We had one a few years back, thorough isn't the word for it!
She was here 3-4 days, matching time sheets to payroll stubs
for every employee.

She was very quite and only had occassional questions, she
did say I paid overtime when by law I didn't need to.

Also since we give bonus's I would not have to calculate
"Halftime on the bonus' when ever an employee had
Overtime and a bonus.

I was fined $700.00 for allowing my then 15-year old
son to work too many hours more than 20-30hrs(?)
for his age.

I told her my father worked me like a slave when his age,
she said it was because we were incorporated that he his
treated like an employee, not a son.

I questioned her on how we were picked for an audit, was
it just random? She said no, usually an employee or a
competitor turns you in.

I also asked her if in the time that she had worked there
if she had ever done an audit and not given a fine and
she said no.

She said my fine was the smallest she had ever seen.

She also left with this nice little gift I have to use when
ever a tech has Overtime and receives a bonus! :(

sorry to hear it JB. my mechanic had a labor audit last year. he has rental property and a disgruntled neighbor to the property called the L.Dept. and said he thought "something fishy was going on" and/or the mechanic was paying guys under the table.

that's all it takes

that guy really got some revenge, though the mechanic is on the "up & up", it still wasted alot of his time...

price of doin business i reckon, my day will come :x

thanx --- Derek.

Thanks, JB.....now I got something else to worry about!! Well, I do keep good records, and I have a payroll company for my employees. The PR company takes care of all that record keeping for my employees.

Time for another Xanax....
